此外，根据47/2014/TT-BCT 通知第 13 条和第 21/2018/TT-BCT 通知第 1 条第 2 款，需要注册电子商务网站的主体是拥有电子商务网站的贸易商或组织。 因此，管理和运营 脸书 的企业必须在工业和贸易部注册。 至于卖方，在脸书上发布销售信息，他们不必在工贸部注册。
因此，通过 脸书销售自制食品无需注册或申请州政府机构的许可。 但是，卖方需要遵守食品安全法规和52/2013/ND-CP 议定第 37 条的规定（关于卖方在电子商务交易大厅的责任），以免侵犯消费者的利益。
通过 脸书 销售自制食品时的纳税义务
根据92/2015/TT-BTC 通知第 1 条，作为居民个人的纳税人包括法律规定的在所有领域和生产经营活动中从事商品和服务生产和贸易的个人、个人团体和家庭，但不包括每年营业额为1亿越南盾的商业个人。
因此，在这种情况下，可以看出，从事直接商业活动或在线业务的个人，特别是通过 脸书 销售食品，每年营业额超过 1 亿越南盾的个人，也必须依法申报缴纳增值税和个人所得税。
缴纳个人所得税和直接缴纳个人所得税的个人，不经过收入缴纳单位，需到应纳税所得额产生地、常住户口所在地或住所地税务机关登记纳税。
应付税款
根据与 92/2015/TT-BTC通知 一起发布的附录 01 的规定，增值税和个人所得税按照应税收入和营业额税率计算。
应税营业额是指本公司在纳税期内从事商品和劳务的生产和贸易活动所产生的销售、加工、佣金和服务提供的全部收入的含税收入（在应税的情况下）。
对于货物的批发和零售活动：
－增值税计算率：1%；
－个人所得税税率：0.5%。
例如：A 女士通过社交网络 脸书出售夜间食品，每年赚取 25亿 越南盾。 因此，A 女士每年都必须向国家机构纳税。 其中包括增值税 2.5亿 越南盾和个人所得税 1.25亿 越南盾。
