企业在经营过程中会面临诸多复杂问题、困难、生产经营盈利压力以及国内外的突然经济波动。严格遵守法律规定再是企业从成立到经营的全过程必须记住。则在许多情况下，企业不或不够了解法律规定，导致违规和被行政处罚。那在规划投资领域，企业会因行政违法被罚款的常见情况有哪些？
商业领域
1. 申报商业登记文件
据第 50/2016/ND-CP 号议定第 24 条规定对规划投资领域的行政违法行为进行处罚，不诚实不准确地申报商业登记文件内容，将罚款 10,000,000至 15,000,000 越南盾。企业必通过注册更改并报告不诚实不准确的申报行为信息来客服。
2.注册更改证书内容
企业变更商业登记证、分支机构或代表处营业登记证或营业地点登记证的内容时，必须办理内容变更登记手续。逾期变更会被罚款如下： (i) 01 至 30 天罚款 1,000,000 至 5,000,000 越南盾； (ii) 31 至 90 天罚款 5,000,000 至 10,000,000 越南盾； (iii) 91 天以上 罚款10,000,000 至 15,000,000 越南盾。
3. 章程资金未足是不变更工商登记内容
据企业法的规定，公司成员/股东必须在商业登记证签发90 日内全额出资。企业未在上述期限内缴足出资的，须到工商登记处办理注册资本变更登记手续。若企业不注册会如何？根据第 50/2016/ND-CP 号议定第 28 条第 3 款的规定，企业将因此处以 10,000,000至 20,000,000 越南盾的罚款。
4、违反企业法定代表人规定
法定代表人重要为代表公司执行商业活动。因此，代表人在越南行使权利是法律所关注的问题。第 50/2016/ND-CP 号议定第 33 条规定，对下列行为处以 10,000,000至 15,000,000 越南盾的罚款： (i) 没有在越南居住的法定代表人； (ii) 企业的唯一法定代表人离开越南时，未以书面形式授权其他人担任代表； (iii) 授权给不符合标准和条件的人。
5. 其他一些违规行为
以下 3 种违规行为将被处以 20,000,000至 30,000,000 越南盾的罚款： (i) 故意定价出资财产不合实际； (ii) 在商业登记证被吊销后继续经营；未经登记设立企业并以企业形式经营。
投资领域
企业的投资活动必向国家主管机构报告。部分企业因举报其活动导致行政处罚的违规行为如下：
– 对于不需办理投资登记证的项目，未向投资登记机构报告而开始实施投资项目的行为处以 1.000.000至5.000.000越南盾的罚款。
–下列行为之一的，处以5.000.000至10.000.000越南盾的罚款： (i) 未提交投资活动报告、投资项目监督报告和投资项目评估报告； (ii) 对投资活动作出不诚实的报告等等
