第一，其具有法律规定的完全民事行为能力。
外国人只有在充分了解 越南2015 年民法典规定的行为后才有权申请工作许可证。
第二，其有适合工作要求的健康。
外国人提供最近6个月的体检证明，体检卡上总是包含医生根据测试信息得出的外国人是否健康到可以工作的结论。 通常情况下，乙型肝炎、传染病等常见疾病都被列为证明外国人身体不适，无法在越南工作的疾病。
第三，其是经理、主管、专家或技术工人。
外国人需要领事馆认证的文件来证明他们的情况。 具体来说：
经理、执行董事的角色：仅要求提供外国人在各自工作中的经验确认。
其他职位和角色：必须提供大学学位和经验确认。
第四，根据越南和外国法律，其不是犯罪分子或正在接受刑事责任审查。
外国人必须通过提供过去 6 个月内的犯罪记录卡来证明他们在东道国和越南没有违反刑法。根据外国人在越南居住的时间长短，确定犯罪记录卡是直接在越南申请还是在国外申请。请注意，在外国使用的文件必须先经过领事馆认证，然后才能在越南使用。
第五、其经国家主管机关书面批准聘用外籍劳工。
第六，外籍劳工需要在越南持有有效签证或临时居留登记证。
申请工作许可的程序
第一阶段：企业和组织申请批准使用外国工人的请求。
至少在雇用外国工人的预计日期前 30 天，雇主（承包商除外）应向劳工部发送一份说明需要雇用外国工人的报告（根据18/2018/TTBLDTBXH通知的表格编号01），战争荣军和社会事务（对于在河内的企业，企业必须向河内劳动、战争荣军和社会事务部提交文件。地址：河内市栋多郡阮志清路75号。
第 二 阶段：为在越南工作的外国人提交新的工作许可申请。
材料包括：
一，外国人工作许可申请表（根据18/2018/TT-BLDTBXH通知的表格编号03）；
二，完全符合卫生部规定条件的医院、诊所或卫生部门的国外体检证明或越南体检证明（12个月内）；
如果外国人在越南进行健康检查，他们需要根据143/KCB–PHCN&GD 官方信函 在列表中指定的医院之一进行检查；
四，在外国发行的外国人的犯罪记录或在越南发行的记录卡（在06个月内发行）；
五，批准雇用外国工人的工作职位的书面通知；
六，外国人有效护照和签证的核证副本；
七，证明自己是经理、高管、专家、技术工人、教师的文件；
八，02（两张）彩色照片，二寸白底，不戴眼镜；
九，与外劳相关的文件（视情况依规定：母公司聘任决定、劳动合同、公司章程等等）。
解决时限
办理工作许可申请时限：直接提交的，自收到完整有效的文件之日起7个工作日。
手续费
新工作许可证：一个许可证400,000 越南盾。
重新签发工作许可证：一个许可证300,000 越南盾。
